Ms. Lowell has been primarily involved in elder abuse and neglect litigation, representing physicians, skilled nursing facilities, residential care facilities, intermediate care facilities, sub acute care facilities and dependent adult residential facilities. Ms. Lowell has successfully defended these providers through all aspects of litigation including jury trial, bench trials and arbitration. Ms. Lowell has also developed an expertise in regulatory compliance issues, HIPAA compliance issues, incident investigation and reporting, and reimbursement issues.  She has successfully defended health care providers through all aspects of regulatory oversight and her practice remains devoted to allowing  health care providers stay focused on the provision of services to the residents and patients within their charge.

Personally

Ms. Lowell graduated from Point Loma College with her BA in Literature and Writing in 1991 and went on to receive her Juris Doctor from Golden Gate University in 1995. In addition, Ms. Lowell received a Certificate in Dispute Resolution from Pepperdine’s Straus Institute for Dispute Resolution in 1995.

Since her acceptance to the California Bar in 1995, Ms. Lowell has worked exclusively in healthcare litigation. She has worked closely with in-house counsel developing and implementing corporate compliance programs and has defended hospitals, physicians and nurses through all facets of litigation. Since 2001, Ms. Lowell has been primarily involved in elder abuse and neglect litigation, representing physicians, skilled nursing facilities, residential care facilities, intermediate care facilities, sub acute care facilities and dependent adult residential facilities. Ms. Lowell has successfully defended these providers through all aspects of litigation including jury trial, bench trials and arbitration. In addition, Ms. Lowell has developed expertise in regulatory compliance and regularly defends providers in their appeals with state and federal agencies. Ms. Lowell has also authored and coauthored numerous articles, procedures, protocols on these topics and is co-authoring Risk Management Solutions to Long Term Care. Ms. Lowell’s reported opinions include Hernandez v. California Hospital Medical Center (1999) 78 Cal.App.4th 498 andGoliger v. AMS Properties, Inc. (2004) 123 Cal. App. 4th 374.
